LAHORE - An additional district and sessions judge on Saturday summoned station house officer (SHO) Civil Lines for 'refusing to register FIR against owners of Facebook who held a contest of drawing blasphemous caricatures on the website. Muhammad Azhar Siddique, chairman Judicial Activism Panel (JAP), had filed application. Azhar told the court that an application for registration of FIR was filed with the Civil Line Police Station but the SHO refused to proceed with the application and did not register a case. He pleaded that the blasphemous act of Facebook amounted to infringement of social values, national and international laws and protocols as well as the Charter of the United Nations. He said the owners of Facebook (Mark Elliot Zuckerberg and Dustin Moskovitz), the artist (Andy) and the management of the website had committed a heinous crime under Section 295-C of Pakistan Penal Code, 1860 (PPC) read with Section 109 PPC as well as other provisions of law in this regard. Section 295-C of the PPC says, Use of derogatory remarks etc, in respect of the Holy Prophet (PBUH), whoever by words, either spoken or written, or by visible representation, or by any imputation, innuendo, or insinuation, directly or indirectly, defiles the sacred name of the Holy Prophet (PBUH) shall be punished with death, or imprisonment for life, and shall also be liable for fine. Petitioner-lawyer further said that Section 109 of the PPC runs as follows: Punishment of abetment if the act abetted is committed in consequence and where no express provisions is made for its punishment: Whoever abets any offence shall, if the act is abetted is committed in consequence of the abetment, and no express provision is made by this Code for the punishment of such abatement, be punished with the punishment provided for the offence. Petitioner prayed that the police be directed to meet the ends of justice and in view of Section 154 of the Criminal Procedure Code, 1898 and verdict laid down by the Supreme Court in a reported judgment, PLD 2007 SC 539 to register a case against the above nominated accused. The judge summoned the SHO for May 25.
