ISLAMABAD - The special court trying former army chief and president Pervez Musharraf for high treason on Thursday issued directives to the prosecutor to provide necessary documents to the counsels and adjourned the hearing for today.
A three-member Special Bench headed by Justice Faisal Arab hearing the case took up a fresh plea of the defense counsel that had urged the court to reframe charges against his client after provision of some documents from the complainant side.
Earlier, the defendant filed a separate application in the court for provision of necessary documents including minutes of the 44th Session of the National Assembly of November 7, 2007, list of the members of the cabinet, including advisors and attorney general of the federal government, governors, chief ministers, chief secretaries, home secretaries, inspector generals of police, members of the cabinet and provincial assemblies of all the four provinces, and the copy of the notification that replaced Gen Pervez Musharraf with General Ashfaq Pervaiz Kayani as chief of army staff.
Substantiating his plea, the defence counsel Shaukat Hayat pleaded that according to the Joint Investigation Team (JIT), total 25 witnesses recorded their evidence but the defendant was provided the copy of 24 witnesses, adding that copy of the resolution passed by the National Assembly supporting the 3rd November 2007 action was also not provided to him.
Justice Faisal Arab observed that the defence side can seek these documents.
Issuing directives to the prosecution to provide documents to the defence counsel till next date the court adjourned the hearing till today.
