RAWALPINDI - Anti-Terrorism Court (ATC) Rawalpindi No 1 on Saturday formally indicted five accused persons for abetting the killing of former prime minister Benazir Bhutto, however, they pleaded not guilty of involvement in her assassination. The ATC Special Judge Chaudhry Habibur Rehman, who had been conducting the trail in Adiala Jail, formally indicted the accused Sher Zaman, Abdul Rasheed, Aitzaz Shah, Rafaqat Hussain and Hasnain Gul for killing, hatching conspiracy to kill her and abetting the perpetrators, using illegal explosive material on December 27 last year when 22 people, including former Benazir Bhutto, were killed and 65 others injured at Liaqat Bagh. However, the accused refused to accept the charges leveled against them and said they would face the trail despite the fact they had already confessed before a judicial magistrate for having the knowledge of the plot to kill Benazir Bhutto and helping the suicide bomber. The court would now summon the prosecution witnesses on November 29 to record their statements. Meanwhile, Nasir Ahmed Tanoli Advocate, the lawyer of the accused while talking to TheNation said that it was unlawful and beyond his understating to indict the arrested men for killing and using the explosives as the investigators had only charged them with criminal conspiracy, abetment, concealing the plot and terrorism in the charge sheet. He also said that he would move against the illegality as the accused could be indicted for the charges leveled against them by the City Police. He further said that the trail of the accused Aitzaz Shah would be held separately as he had been declared as a juvenile offender by a medical examination. He has been declared below 18 years by the medical examination. The court separately indicted the two accused, Rafaqat and Hasnain, for providing lodging and facilitating the suicide bombers who hit first at RA Bazzar in September last year and the second at the gate of Golf Club in October 2008. The accused also pleaded not guilty in these cases. Moreover, the court, in yet another case, indicted five accused persons, Said Arab, Tehseen Ullah, Gul Roze, Muhammad Shafique and Abdul Rasheed for firing four rockets at Kamra Aeronautical Complex in Attock in January 2008. The accused have denied the allegation.
