PESHAWAR-The Peshawar High Court on Friday summoned investigation officer along with record in the medical student Asma’s murder case in Kohat.
The medical student was shot dead in Kohat over matrimonial issue last month.
Smelling threats to his lawyers, Muhammad Irfan, brother of the victim, has filed an application in the court through his lawyers, Ghulam Mohiyuddin Malik and Farooq Ahmad Malik, requesting the court to shift the case from Kohat to Peshawar.
The petitioner in the application said that there is threat to their lawyers as the rival family is influential.
A single-bench hearing the application, headed by Chief Justice Yahya Afridi, has issued notice to the rival parties in the case to hear their point of view over the transfer of case from Kohat to Peshawar.
The bench fixed March 2 for the next hearing.
The petitioner's lawyers informed the bench that the suspected murderer belonged to an influential family and using influence to give threats to the victim’s family. He requested the court to transfer the case to Peshawar.
The provincial government and arrested suspect, Shah Zeb, who played the role of ‘facilitator’ as per the police report, were made parties in the petition.
The victim was a third-year student of Ayub Medical College, Abbottabad and was allegedly shot dead by Mujahidullah Afridi on January 27.
In her dying statement that was a video-recorded message by her family, she had named Mujahidullah Afridi as the killer.
Afridi has escaped abroad on the day of the incident by taking a flight out of Islamabad. The KP government claimed that efforts were underway to arrest the culprit through the Interpol.
In the application, the victim’s brother said that the close relatives of the accused included the PTI district president, a local MNA, and some practicing lawyers in Kohat.
Mohammad Irfan said in the application that they used all resources to engage a local lawyer for pleading the murder case of his sister in Kohat but no one accepted the brief of the case.
The petitioner claimed that on each hearing their opponents accompanied by supporters were hostile towards them and that’s why he and his relatives felt threatened due to their hostility.
“The atmosphere is unsafe and uncongenial in Kohat for me and my lawyers from Peshawar,” he claimed.
He requested the court to transfer the case from Kohat to Peshawar.
