ISLAMABAD - The Supreme Court on Friday upheld the Election Commission of Pakistan’s order regarding disqualification of Pakistan Tehreek-e-Insaf member of Khyber Pakhtunkhwa Provincial Assembly Abdul Munim Khan.
Munim was serving as an advisor to Chief Minister Pervaiz Khattak and was a legislator from district Shangla in KP.
He was elected MPA from PK-88, Shangla in 2013 general elections as an independent candidate before joining the Swabi-based political party, Awami Jamhoori Ittehad Pakistan, which later merged into the PTI.
A three-judge bench, headed by Justice Sheikh Azmat Saeed, was hearing the PTI ex-MPA appeal against the Islamabad High Court decision. In April last year when the Election Commission of Pakistan had given a verdict against Munim he had filed the writ petition in the IHC.
However, the high court ordered to file an appeal in the apex court against the ECP order. Munim Khan therefore had approached the apex court. His rival Sher Alam Khan, candidate of Jamiat Ulema-i-Islam-Fazl, challenged his victory in the Election Commission of Pakistan.
Sher had claimed that Abdul Munim, special assistant to the chief minister on tourism, was a schoolteacher and had tendered resignation on March 31, 2013, a few days before scrutiny of his nomination papers. The ECP had de-seated PTI MPA on the basis of allegations that he was a government servant months before 2013 general elections. Munim was asked to return all the amount of salary he received as a lawmaker.
The ECP had also ordered the registration of an FIR against the former MPA for giving a false undertaking at the time of 2013 general elections.
