Plea against JC dismissed

LAHORE - Justice Ijazul Ahsan of the Lahore High Court Monday dismissed a petition challenging formation of judicial commission to probe 2013 general elections. The judge observed that the petition was not maintainable.
“Constitution of a judicial commission is the discretionary power of a chief justice,” remarks the judge. Mohayyuddin, a lawyer-petitioner, had filed the petition and submitted that many commissions were constituted but their recommendations had not been taken seriously. What was the benefit of a commission if its recommendations were not implemented, he contended.
He said a judicial commission gave recommendations on Model Town incidents but a JIT was made later which declared all the politicians involved in it as innocent. The petitioner requested the court not to accept the government’s request regarding the formation of a commission.
In another case, the LHC restrained a trial court from holding proceedings against former secretary election commission Afzal Khan till September 9. A member of the election commission Riaz Kiyani had filed petition against him. Afzal Khan said that sessions court could not proceed against him. On it, the LHC restrained sessions court from proceeding against Afzal Khan and sought reply from petitioner Riaz Kiyani.
