KARACHI - Sindh High Court (SHC) on Wednesday replaced DIG Bashir Ahmed Memon with Senior Superintendent Police SSP Niaz Khoso to carry out inquiry into the killing of Abdul Rehman Baloch alias Rehman Dakait and his three aides in suspected police encounter. The division bench of SHC comprising Chief Justice Sarmad Jalal Usmani and Justice Ahmed Ali M Sheikh disposed of the revision application moved by the state challenging the SHC order. The order was earlier passed to assign DIG Memon as the Inquiry Officer to probe the case of alleged police encounter in which Rehman Baloch, Aurangzeb Baloch, Nazeer Baloch and Aqeel Ahmed Baloch were shot dead by the police in an encounter. CJ Sarmad Jalal Usmani inquired state counsel advocate Shaukat Zubairi about his opposition for assigning DIG Bashir Memon as investigation officer. He replied that according to the Police Order 2002, only provincial police officer is entitled to assign an investigation officer but the court asked that there were several such verdicts have been passed in which the IOs were assigned by the court. Advocate Khalid Shah, who was counselling the petitioner, insisted to remain intact the services of DIG Memon as IO as he almost completed his inquiry process. On his request, the court directed to resume the inquiry which he left. In the meantime, the family members, who were petitioners to conduct inquiry over the killing of the four against SSP Aslam Chaudhry, protested in the court room and insisted the court to keep DIG Memon as IO. Afterwards, with the consent of both the counsels, the court assigned SSP Niaz Khoso as IO of the case. The court directed to resume the inquiry process that has almost done by DIG Bashir Memon. It is worth mentioning here that the government challenged the SHC decision of appointing DIG Memon as IO. The said SHC judgment came on two petitions moved by widow of Abdul Rehman Baloch, Farzana and sister of Aurangzaib, Farah, sought judicial inquiry in the alleged police encounter took place on August 9, 2009.
