Supreme Court of Pakistan Monday directed the government to reinstate the investigation team of FIA headed by Hussain Asghar constituted to make a probe into the Hajj Corruption scandal. The court also directed that notification in this behalf should be submitted with the Registrar office of the court. A six member larger bench headed by Chief Justice Iftikhar Muhammad Chaudhry and comprising Justice Shakirullah Jan, Justice Tariq Pervez, Justice Khilji Arif, Justice Ameer Hani Muslim and Justice Ghulam Rabbani, made the observation during hearing of the Haj scandal case on Monday. Attorney General (AG) Maulvi Anwar ul Haq appeared before the SC bench while Additional Director General (DG) FIA was not present in the court. The court expressing its anguish over his absence directed for his appearance but was informed that he has left for Karachi. The court also sought explanation from former Secretary Establishment Rauf Chaudhry for not implementing the court orders The Chief Justice Iftikhar Mohammad Chaudhry in his remarks said the government did not want to implement the court orders and corruption cases were being delayed under different pretexts. He further said that the court had ordered for action against investigating officer Javed Bukhari within four weeks but two months have been passed and court orders have not been implemented yet. He said the Hajis were plundered and Lotas were being given protection. He said those violating the court orders would be sent to jail and then the court would listen them. He said DG FIA may be a big officer but he will have to appear before the court. The Chief Justice said that when proceedings on a certain case make progress concerned investigation officials are transferred which results in halt in inquiry of that case. He said investigation officer Hussain Asghar was a honest officer and he was transferred because there was progress in the case. Justice Ghulam Rabbani observed that the government was deliberately not implementing the court orders. Justice Tariq Pervez said that it seems so that the government was asking court to do whatever it can, and it does not care for court directives. Commenting over the transfers of FIA official heading the investigation team, Justice Mian Shakirullah Jan said that court can itself issue the directives to reinstate Hussain Asghar as head of investigation team probing into Hajj scandal. The court also took serious notice of absence of Secretary Establishment Division and directed AG to ensure his presence on Tuesday. Chief Justice Iftikhar Chaudhry remarked that there was no need of sending any summary to the Prime Minister and the court would itself issue the orders. He directed the Secretary Establishment Division to bring the relevant file and the court would issue the orders itself. At this point,Deputy Secretary Establishment Khalid Rasood informed the court that investigation was going on into 34 kanal land of former Religious Affairs Minister Hamid Saeed Kazmi. The Chief Justice observed that Ministers were involved in this case and that was why the government was transferring officers to divert attention from this case. The hearing of the case will continue on Tuesday.
