IHC moved for filing of case against Lal Masjid cleric

islamabad - A writ petition seeking court’s orders to federal police for registration of a case against Lal Masjid cleric Maulana Abdul Aziz and others was yesterday moved in the Islamabad High Court.
The petitioner, Syed Khurram Zaki, filed the petition through his counsel Asif Mumtaz Malik Advocate and cited Secretary Interior, Secretary Law and Justice, Secretary Defense, Director General ISI, Director General Punjab Rangers, Chief Commissioner Islamabad, Inspector General of Police Islamabad, Senior Superintendent of Police Islamabad and SHO Aabpara Police Station as respondents.
He stated in the petition that students of Jamia Hafsa situated in G-7/3, Islamabad released a video on social media wherein they invited Daesh (ISIS), which is a banned outfit, to come Pakistan and kill people, chop their hands, cut their necks, tear apart their bodies to take revenge of Osama Bin Laden (Al-Qaida leader) and take revenge of Lal Masjid students from Pakistan Army.
He contended that the message released by the students in support of banned outfit Daesh was lethal in its nature and amounts to mutiny and waging war against the state of Pakistan which is a heinous crime punishable with death or imprisonment for life.
The petitioner argued that the said message has been owned by the head of Jamia Hafsa Maulana Abdul Aziz and her wife Majida Younas alias Umme Hassan, in a story published in English newspaper on 15-12-2014.
Advocate Asif told the court that his client lodged an application for the registration of FIR at Aabpara Police Station on 03-02-2016 but unfortunately the respondent No.9 did not register any FIR.
Resultantly, he added that the petitioner filed an application under section 22-A and 22-B of Cr.P.C. before the Sessions Court Islamabad on 09-02-2016 which was entrusted to Raja Asif Mehmood learned Additional Sessions Judge, who turned down the said petition on 07-03-2016. As a result, he has moved the IHC for registration of the case against Lal Masjid administration.
The petitioner prayed to the court that the respondents may very kindly be directed to take the cognizance of the offence, with immediate effect, and the respondent No.9 may specifically be directed to register FIR against Maulana Abdul Aziz, Majida Younas alias Umme Hassan, and students of Jamia Hafsa, Islamabad under the enabling sections of Anti-Terrorism Act 1997, Protection of Pakistan Act 2014, Pakistan Penal Code 1860 and under all other relevant sections of criminal laws of Pakistan.
