ISLAMABAD Supreme Court on Thursday referred a lawyers case, who has challenged the position of both Chief Justice Iftikhar Muhammad Chaudhry and Justice Ramday as judges, to the Punjab Bar Council (PBC) for initiation of a disciplinary action against him for his attempt to scandalise the judges of superior judiciary. A six-member larger bench headed by Chief Justice Iftikhar Muhammad Chaudhry and comprising Justice Chaudhry Ijaz Ahmed, Justice Khilji Arif Hussain, Justice Rahmat Hussain Jafferi, Justice Tariq Pervez and Justice Khalilur Rehman Ramday dismissed the plea of Hanif A Rahi Advocate seeking formation of a new bench sans the Chief Justice, Justice Ghulam Rabbani and Justice Khalilur Rehman Ramday. The bench wrote, in its judgment, that the petitioner challenged position of both the Chief Justice and Justice Khalilur Rehman Ramday as judges. We have gone through the plea, which is nothing but a scandalous attempt, the bench said and added it was an attempt to scandalise the judges without having any reason. It may be mentioned here that Hanif Rahi appeared in the appeals against his conviction in a contempt of court case by an additional sessions judge and high court judge. The bench noted that the petitioner was not interested in arguing his appeal and the civil miscellaneous applications. His case was referred to the Punjab Bar Council for initiation of the disciplinary proceedings against him, the order said. It is relevant to mention here that the petitioner is not the SC lawyer and not capable to appear before the apex court as lawyer. Outside the SC building, when reporters inquired from Rahi regarding main points of his petition, he could not recite more than two points of it that he could do so after reading the petition, which showed that he was not author of his petition that was probably written by someone else to scandalise the apex court judges. Riaz Rahi, in his arguments, said that he would not argue regarding merits of his three cases, as he had submitted an application against the sitting Chief Justice and two other ad hoc judges, therefore a separate bench should be reconstituted. I do not regard two of them as judges. Let me allow to argue the case, if it is proved wrong, then cancel my license and send me to jail, he added. Citing news clippings about statements of the Chief Justice and Justice Ramday, he said the Chief Justice had stated that he would render any sacrifice for dispensation of the justice. Justice Ramaday has said that a society could not survive without justice, so let me speak, if they stop me from taking up my case then it would go against concept of independence of judiciary and justice, he added. Chief Justice reprimanded him by saying that it was sheer way to scandalise the judges. Justice Ramday repeatedly asked him to remain silent and told him that a court could not function without a Chief Justice and if he considered this court as unconstitutional then why he was arguing. You should go to any other country for this purpose, Justice Ramday further said.
