ISLAMABAD (APP) - Balochistan Bar Council has requested the Parliamentary Committee on appointment of judges in superior courts not to consider the recommendations made by the Judicial Commission about confirmation/appointment of judges in the Balochistan High Court terming them as invalid. In a letter written to the Chairman Parliamentary Committee for appointment of judges in the Superior Courts, Chairman Executive Committee of Balochistan Bar Council Munir Ahmed Kakar said, The recommendations for confirmation/appointment of judges, including the Additional Judges, in the Balochistan High Court, not being valid recommendations, may not be approved till such time, the same come from a validly constituted Judicial Commission i.e. 175(5) (II) and 175(A)(5) (IV) and law. According to Munir Ahmed Kakar, who is also member of the Balochistan Bar Council (BBC) said that copy of the letter had also been dispatched to all the members of the Parliamentary Committee, Vice Chairman Pakistan Bar Council, President Supreme Court Bar Association, Federal Minister for Law and Justice, Attorney General of Pakistan and Federal Secretary Law, Justice and Parliamentary Affairs. The Judicial Commission in its meeting held on April 23 has recommended appointment of Judges in the Balochistan High Court, which included the Additional Judges as well. That the Balochistan Bar Council also apprised the Judicial Commission, vide letter dated 23-04-2011, regarding appointment of judges in the Balochistan High Court cannot be considered on account of constitutional disqualification of Muhammad Kamran Mullah Khail as member of the Judicial Commission.
