Rawalpindi-Lahore High Court (LHC) Rawalpindi Bench Justice Muhammad Tariq Abbasi on Friday has rejected a petition filed by a property tycoon seeking dismissal of a private complaint filed against him by a kiln owner with a lower court while accusing him of grabbing his land illegally.

The court ordered the petitioner to file an application under 265-D of CrPc with the lower court. The lower court has fixed March 4, 2021 to frame charges against the petitioner (property tycoon).

According to details, the petitioner Chaudhry Abdul Majid, the Chief Executive Officer (CEO) of Zedem International and Faisal Town (Pvt) Limited, through his lawyer Taimoor Aslam Khan Advocate, filed a petition with LHC Rawalpindi while making District and Sessions Judge Izhar Shaukat, the kiln owner Syed Ameer Ali Shah and Syed Inayat Hussain Shah respondents.

In the petition, the petitioner stated he was accused by the respondent number 2, Izhar Shaukat, of storming into his leased land where he built a kiln along with men to grab it illegally.

He argued the lower court has accepted the application for hearing and was all set to frame charges against him following the statements of witnesses. The petitioner pleaded the apex court to accept his petition for hearing and to set aside an Impugned Order dated 15/1/2021, resultantly may be pleased to dismiss/reject the private complaint filed by section 3 of the act by the respondent Izhar Shaukat, in the interest of justice.

The protection Raja Ziafat has opposed the arguments of defendant and requested the court to dismiss the petition and to allow lower court to continue hearing of the case. After completion of arguments of both parties, the LHC Rawalpindi Bench Tariq Mehmood Abbasi set aside the petition of property tycoon and ordered him to file an application with lower court under section 265-D.
