ISALAMABAD - Defence counsel of Nawaz Sharif Khawaja Haris while continuing his conclusive arguments in the Avenfield corruption reference Tuesday contended that the statements of JIT head Wajid Zia and investigative officer regarding ownership of London flats are contradictory.
During the hearing of Avenfield corruption reference in the Accountability Court, Khawaja Haris, Defence Counsel for Sharif family, said that JIT head Wajid Zia has declared that London flats belong to Sharif Family whereas the NAB Investigative Officer says that Nawaz Sharif is Benamidar of London apartments.
He said during cross-questioning Robert Redley admitted that Calibre font could be utilised by downloading it from the internet. Redley also admitted that he personally used Calibre font whereas he was neither an IT expert nor a computer professional.
While quoting the statement of NAB’s investigative officer, Khawaja Harris stated that as per finding of the investigative officer Nawaz Sharif is Benamidar of London flats. The prosecution presented the chart in this regard but did not produce any witness in this connection in the court, Khawaja Harris said, adding evidence employed against Nawaz Sharif by the prosecution must be put for cross-questioning. The chart presented by the prosecution in this regard against Nawaz Sharif could not be utilised, Khawaja Harris added.
He said that witness Sidra Mansoor also admitted that he got the chart through the Auditor report. Mosaic Fonica is a private law firm and does not own any governmental supervision. The JIT did not inquire from the Mosaic Fonica about status of Nawaz Sharif being owner and beneficial owner of London apartments, Khawaja Harris said. He said that JIT might not have inquired all these anomalies as JIT personnel already know that British Virgin Islands (BVI) is not alike FIA but it is similar to AG Office. He said if the letter has received from the AG office on this particular issue Defence lawyer Amjad Pervez will also give his arguments. It is still to identify how did letter from the BVI reached Pakistan.
The defence counsel also pointed out that cross-questioning is made on secondary evidences and share holder certificate were also attached with the registration, those are also missing, these are not documents but only letter. “How did the court judge whatever inscribed in this letter is either right or wrong,” Khawaja Harris questioned, adding on these grounds this letter could not be considered as acceptable evidence.
While making conclusive arguments on the statement of Robert Redley, Khawaja Harris stated as per the statement of Redley Calibre font was not commercially used before 2007. He said that there are two reports of Robert Redley. He added that first report of Redley was based on some mistakes in the documents. The JIT was handed over the trust deed of Comber, Nelson and Nescol. He said that the trust deed based on correction was made part of the judicial record and on the second report of Robert Redley inscribed the words of Panama case. He said the report has addressed the court and same pages of the Nelson and Nescol have been pinned while for Comber second version of the report could be termed in this regard. As earlier, mistakenly on one page of Comber, two pages of Nescol and Nelson were pinned while making a photocopy, he added.
He said if Redley said Calibre font was not available for commercial use before 2007 and therefore this report is not correct. He said three pages of Nelson and Nescol were collected at the very time as it was a mistake about the font and this mistake was admitted in our report and analysis.
Khawaja Harris also pointed out that later statement of Redley witnessed to the fact that his credibility and report have raised various question marks. During cross-questioning, he said, Robert Redley confessed in cross-questioning that Calibre font was utilised before 2007 on experimental grounds by downloading it from the net.
The court adjourned the hearing for Wednesday with permission for Khawaja Harris to continue conclusive arguments in corruption reference.
