Supreme Court on Wednesday adjourned hearing of the constitutional petitions challenging the 18th amendment for two weeks and sent the case to the Chief Justice for constitution of a larger or full bench for hearing, a private TV reported. The bench also issued notices to the federation and other parties in case. Akram Sheikh Advocate in his arguments before the court said the formation of the judicial commission under the 18th amendment has been against fundamental structure of the constitution and freedom of the judiciary and pleaded to the court to cancel the provision. Justice Jawad Khwaja, a member of the bench, asked the counsel when the Chief Justice will be head of the judicial commission how it will curtail the freedom of the judiciary. Akram Sheikh responded the government can influence two retired judges in the commission. Justice Rehman Hussain Jaffery said in the old procedure the minister of law had a prominent role, now he has been replaced with two retired justices, how it can affect. The counsel said that the judicial commission is part of the US constitutional scheme, which is different than our system so as the provision should be struck down. Akram Sheikh has completed his arguments today. Hamid Khan Advocate will start his arguments in the next hearing of the case.
