SC summons proposer, seconder in Sharifs case

ISLAMABAD- Supreme Court has summoned the proposer and seconder of nomination papers of former Premier Nawaz Sharif to appear before the court in person today asking them whether they press the demand for formation of an appropriate bench to adjudicate upon the Sharif brothers' eligibility case. A three-judge bench of the apex court comprising Justice Muhammad Moosa K Leghari, Justice Syed Sakhi Hussain Bukhari and Justice Sheikh Hakim Ali summoned Maher Zafar Iqbal and Shakil Baig, the proposer and seconder of PML-N Chief Nawaz Sharif after the opposite side questioned their locus standi as well as their genuineness. Advocate Ahmed Raza Kasuri, the counsel for Syed Khurram Shah, who obtained an adverse ruling against the Sharif brothers from Lahore High Court on June 24 last year and got the elder Sharif disqualified, stated that Zafar Iqbal and Shakil Baig were the front men of PML_N leaders. Opposing an application seeking formation of a larger bench consisting of those deposed judges of the apex court who have recently been restored, Ahmed Raza Kasuri argued that all the judges have taken oath under the amended constitution and Provisional Constitution Order (PCO) whereas no discrimination can be crafted against the superior judiciary. Seeking the rejection of application for fresh bench, Kasuri also stated that oath had become part of the Constitution and the now it was up to the Parliament whether or not to ratify the amended constitution. Pointing out to the absence of the secondar and proposer of Nawaz Sharrif during the proceedings throughout the hearing, Kasuri said any one who is not present before the court has no locus standi. Lauding the Iqbal Tikka Case in which Supreme Court had validated the November 3, 2007 steps of former President Pervez Musharraf, Kasuri said the verdict delivered by the apex court spoke for wisdom and prudence (of the superior judiciary). "Democratic order in place at present is owing to decisions of courts", he further claimed. Kasuri also stated that the oath taken by the judges under specific circumstances was a right decision, adding that if the judges had not done so, the constitutional institutions might have tumbled down. He also alleged that the 'scrap dealers were now doing business of human scrap and want formation of a bench of their own choice to extract an order of their own choice'. Kasuri also stated that on one hand the PML-N leaders claim to be champions of respect for judiciary and on the other hand they were bringing disgrace to the courts as the seconder of Nawaz Sharif challenged PCO judges in a derogatory language through his counsel. He also requested the court to summon the proposer and secondar before the court on next hearing. Allowing the request the bench directed both Zafar Iqbal and Shakil Beg to appear in person before the court today. The counsels of both these persons were also directed to file affidavits before the court. At this stage, Muhammad Akram Sheikh, the counsel for proposer of Nawaz Sharif also requested the court to summon Syed Khurram Shah and Noor Elahi, the objectors against Sharrif brothers. He further alleged that both these persons were ghost and do not exist. However, the court issued no direction about Syed Khurram Shah or Ellahi. Kasuri was still on his legs when the apex court adjourned the hearing till today.
