PPP to avoid confrontation with SC

ISLAMABAD - After a late night discussion at Prime Ministers House, the legal wizards of PPP finally came up with the decision to adopt conciliatory course and avoid confrontation with the Supreme Court over the explanation sought by the apex court from Prime Minister on making Federal Secretary Establishment Sohail Ahmad OSD, ostensibly for compliance with the court orders. In the meeting which remained in session for several hours at Prime Ministers House on Wednesday night, the party leaders discussed the notice given to Prime Minister by the Supreme Court seeking explanation from him on making Secretary Establishment Sohail Ahmad OSD when he in compliance with the court orders had transferred back FIA officer Hussain Asghar in FIA to head the Haj scam investigation. Conspicuous among those who were present in the Prime Ministers House meeting included Federal Minister for Law Maula Bux Chandio, Senator Babar Awan, Attorney General Maulvi Anwarul Haq and Adviser to Prime Minister on Law Ghulam Farooq Awan. Sources in the government informed The Nation that there were strong reaction from some of the senior party leaders and even a few Cabinet members were of the view not to bow down to unjust and undue pressure from the Supreme Court, but the saner elements in the party were of the view that government should not adopt the confrontational course as it would be detrimental to the incumbent political dispensation. Finally, the doves in the party prevailed and it was decided that government must avoid clash between the institutions, as country could not afford such a confrontation at this critical juncture when country was fighting a war against terror. Even some of the Cabinet members during the Cabinet meeting earlier in the day spoke foul against the apex court and termed the present direction of the court as infringement on the powers of the executive. But Prime Minister Syed Yousuf Raza Gilani had calmed them down and made it clear that they have all respect for the superior judiciary and they would comply with the court orders remaining within the ambit of law and Constitution. Later, in the meeting with the legal team after some difference of opinion they finally reach consensus that government would place the technical reasons for making Secretary Establishment OSD and would realise the apex court that action was taken against him not for the reason that he had complied with the court orders but for his exceeding jurisdiction during the process. On Thursday, Attorney General Maulvi Anwarul Haq would once again reiterate the governments commitment before the apex court that Government has no intention to defy the Supreme Court and all its verdicts would be complied with in true letter and spirit. Sources further said that Attorney General would also explain the procedural and administrative hiccups due to which the implementation on the apex court orders is being delayed. It is pertinent to mention here that Secretary Establishment Sohail Ahmad had implemented the Supreme Court orders and issued notification to bring back Hussain Asghar into FIA to head the Haj scam investigation reportedly without taking prior permission from Prime Minister Syed Yousuf Raza Gilani. Consequently, Prime Minister had made Secretary Establishment Sohail Ahmed OSD for exceeding his powers in the process. On Wednesday, the court taking notice of it directed Attorney General to file the written reply of Prime Minister in the matter on Thursday.
