Granting the appeal filed by Arsalan Iftikhar, son of Chief Justice Iftikhar Muhammad Chaudhry, the Supreme Court on Thursday ruled that the controversy relating to allegations of a Rs 342 million business deal between Arsalan and property tycoon Malik Riaz be probed by a commission. The Supreme Court (SC) ordered the National Accountability Bureau (NAB) to stop investigations against Dr. Arsalan Iftikhar son of Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry and announced constitution of an independent commission for further probe. The bench decided that a separate commission, headed by Shoaib Sadal, would be formed to probe the case added that Sadal should be given all legal power to investigate the matter. The commission, constituting Shoaib Suddle, has been directed to submit its report before the bench in a period of 30 days. The bench enabled the commission to collect all evidence pertaining to the controversy and also sanctioned that trips abroad may be undertaken for collecting proof. Suddle would also have the authorities enjoyed by a judicial officer and would also investigate the protocol given to Malik Riaz by two police officers when the real estate tycoon appeared before the Supreme Court on July 31. Reading out the verdict on a review petition filed by Arsalan Iftikhar, the apex court also directed to form a probe commission to investigate the case pertaining to allegations levelled by property-baron Malik Riaz against the son of chief justice. Two-member bench of the apex court comprising Justice Khilji Arif Hussain and Justice Jawwad S. Khwaja, reserved the verdict on Tuesday. It should be noted here that Arsalan Iftikhar had filed a review petition challenging the Supreme Court’s order of June 14 regarding corruption allegations hurled by the property baron Malik Riaz. Counsel of Arsalan Iftikhar, Advocate Ishaq Khan, told the court that his client has no faith in the inquiry being carried out by the National Accountability Bureau. While reserving the judgment on the petition, Justice Jawwad Khawaja said that the court will announce judgment in a day or two following consultations. Later, talking to media persons, Arsalan Iftikhar stressed the need for impartial probe into the whole issue. Dr Arsalan Iftikhar, son of Chief Justice Iftikhar Hussain, has been accused of receiving between Rs300 and Rs400 million from real estate tycoon Malik Riaz to influence judicial proceedings.
