LAHORE - A petition has been filed in the Lahore Registry of Supreme Court of Pakistan by former prime minister Nawaz Sharif, his wife Kalsoom Nawaz and Shahbaz Sharif against tax departments notices regarding tax evasion during 1994 to 1998. Sharif family has filed this petition before Lahore of the Supreme Court. The petitioners had been directed by the tax commissioner of Lahore to pay more than Rs 10 million as wealth tax on their value of shares of their companies for five years 1994-95, 1995-96, 1996-97and 1997-98 within the stipulated period. They moved a writ petition before the Supreme Court. Petitioners counsel Malik Tariq Aziz moved petition before the apex court in which he requested to declaring the calculating wealth tax liability under Rule 8(2) CI of the Wealth Tax Rules, 1963. He said under this rule the income tax department takes into account the face value of shares of non-registered companies as well as their market value and calculated the tax on whichever was higher. But by contrast, the shares of companies listed on the stock exchange, were taxed in accordance with the lower value. If the market value was higher, the tax was levied on face value and vice versa. Counsel said that this rule was discriminatory and violative not only of the parent law, the Wealth Tax Act of 1963, but also of Articles 4, 18, 24, 25, 141 and 142 of the Constitution. Counsel requested the court to declare imposition of wealth tax null and void.
