Judgement on Babar Awan reserved by court in Ex-CJ defamation case

Islamabad: The court has reserved judgment on the petition filed by counsel for former Chief Justice of Pakistan (CJP) Iftikhar Chaudhry, raising objections on power of attorney in respect of Babar Awan advocate counsel for Imran Khan, in defamation suit against PTI chief.

The case came up for hearing in the court of district and sessions judge Islamabad Muhammad Tanvir Mir today.

Sheikh Ahsan ud Din advocate appeared on behalf of former CJP Iftikhar Muhammad Chaudhry and Khawar Amir Bokhari advocate represented PTI chief Imran Khan in the court.

Sheikh Ahsan ud Din advocate while raising the objection said that Dr Babar Awan has not filed reply to the objection raised against his power of attorney despite court’s orders. This falls in the ambit of contempt of court.

Khawar Amin Bokhari advocate said that this court has no jurisdiction to hear this case because no district court can hear damage claim case exceeding Rs 100 million. The court while expressing displeasure remarked , “ why has the reply not been filed despite court’s orders.”

Khawar Amin Bokhari advocate said the lawyers of the petitioner have also never filed reply on the petitions filed by his side. Court has rejected our petitions one sided.

The court observed “ if you have any objection over any order of court then you can resort  to the high court.”  The court while reserving judgment adjourned the hearing of the case indefinitely.

 Talking to journalists outsihe court, Sheikh Ahsan ud Din advocate said “ the rival party is breaching court’s dignity. Non complying court’s orders falls in the ambit of contempt of court. Khawar Amir Bokhari while talking to journalists said, “We respect courts. But raising objection within the parameters of law and constitution is our right, therefore, we are exercising our right”.
