ISLAMABAD - Maulana Sami-ul-Haq, Ameer Jamiat Ulema Islam (Sami Group), and chairman Pakistan Defence Council (PDC) on Tuesday filed a constitution, demanding make agreements with the US/NATO/ISAF forces regarding 'Shamsi Airbase and Drone attacks on Pakistani soil public and declare them unlawful, ultra vires to the Constitution and in violation of the fundamental rights. The JUI (S) Ameer filed the petition under Article 184(3) of the Constitution and made federation through secretary to the President, federal government through principal secretary to Prime Minister, federal secretaries Ministries for Defence, Interior and Foreign Affairs, Chief Secretaries and Secretaries of all the provincial governments and governors respondents. He questioned it is not the basic law of the country that armed forces, under the direction of the federation govt, required to defend Pakistan against external aggressions or threats of war, and the federation has been vested with the power to have control and command of the armed forces under Article 243 then killing of 26 soldiers were in the absence of any control and command of goverment? Maulana Sami-ul-Haq stated that from 2004 to 2011 about 2634 citizens were killed in 227 drone attacks, while under Article 9 of the Constitution it is the federation is duty bound to protect and provide security to the citizens. He questioned that by allowing the United States and NATO forces launch drone attack is not the violation of fundamental rights of people? The federal government in accordance with the provision of Constitution must fully secure the fundamental rights and protect their individual lives and personal liberties. Muhammad Muazzam Butt counsel for the petitioner stated that in view of Article 19(A) of Constitution every citizen has right to access to information in all matters of public importance. He therefore prayed that the federation be directed to publish all the agreements with the US/NATO/ISAF related to Shamsi Airbase and Drone attacks on electronic and print media for information to the public at large. He further prayed the respondents may be directed to refrain from allowing any space, area, land and territory to any other state or country or their armed forces for launching operations in Pakistan or against any other state of country and in case if it is so needed then the matter shall be referred to the parliament for debate and appropriate decision and to formulate police in the public interest.
