This is regarding a recent statement of Attorney General Mr. Latif Khosa that Justice Iftikhar Muhammad Chaudhry cannot be reinstated as CJ even if Mr Zardari wanted to do so. The reason quoted by the AG is that a defacto President (Musharraf) had deposed him. This looks like a somersault by Mr. Khosa as not too long ago, he was also on the forefront of the lawyers' struggle for reinstatement of all deposed judges. He also tends to forget that Justice Chaudhry was deposed by Musharraf in his capacity as a COAS, and not as President. And by Mr. Musharraf's own admittance, it was an unconstitutional act which had brought forth an illegitimate CJ in place of the legitimate one. As such the above action was void ab-initio and no amount of legal skullduggery can make this illegal act legal as it was carried out by a man in uniform. The act was falsely accepted by an illegitimate SC bench, which had its own self-interest at stake in this case. As the Persian saying goes; Tu mara Haji begoim mein tura Haji bego or (you call me a Haji and I will call you a Haji). The blatant violation of constitution by a former dictator in collusion with some judges cannot be accepted as a past and closed transaction because it was based on the false edifice of illegality. -DR M.
