ISLAMABAD - The Islamabad High Court yesterday served notices on the National Accountability Bureau chairman in a contempt of court petition over illegal confinement of one Masroor Sarwar despite the pre-arrest bail granted to him by the IHC.

A division bench of the IHC, comprising Justice Noor-ul-Haq Qureshi and Justice Athar Minallah, also directed the NAB chairman to submit his reply to the contempt of court petition in which the petitioner had alleged NAB kept him in illegal confinement despite the pre-arrest bail obtained by him from the court.

The petitioner who is presently confined at Adiala Jail moved the court through his counsel Muhammad Anwar Dar and nominated NAB Chairman Qamar Zaman Chaudhry and Assistant Director Umair Ahmed as respondents.

He stated in the petition that he received a call-up notice from the NAB upon which he filed a pre-arrest bail application and an IHC bench granted him interim bail against the surety bond of Rs 500,000 on February 15, 2016.

He added, however, the bail confirmation proceedings remained pending when on June 21, 2016, the final arguments were heard. “When I came out of the courtroom, Assistant Director Umair Ahmed and three other persons, on the directions of the NAB chairman, kidnapped me from the court premises, stating that my pre-arrest bail petition had been dismissed,” the petitioner said.

The petitioner maintained that then he was brought to the NAB headquarters where he was physically tortured though it was in the knowledge of the respondents that he was on a pre-arrest bail.

The petitioner contended that on June 22, 2016, the NAB officials produced him before the accountability court of Islamabad and obtained his physical remand, concealing the facts that he was already on bail.

The petitioner is involved in a land fraud case in Pakistan Postal Housing Foundation. The petitioner said that he did not commit any fraud.

Masroor Sarwar argued that the NAB obtained his physical remand on the basis of fake and false documents prepared by them. On August 8, 2016, he received certified copies of the IHC orders regarding his bail, but he has been in illegal detention at Adiala Jail since June 21, 2016, in violation of the law.

He prayed to the court to initiate contempt of court proceedings against the respondents and order his release from the jail.
