LAHORE - MIAN DAWOOD - The judicial commission, formed two years ago to probe alleged plot to assassinate former Lahore High Court chief justice Khawaja Sharif, commended a cancer-hit sub-inspector for his honesty and courage.

“We commend Punjab Special Branch Sub-Inspector (SI) Shakeel Hassan for his honesty and for he was the only one who did not bowed to pressure from very senior officers,” the commission report said.

The panel led by the Balochistan High Court Chief Justice Qazi Faez Isa found that four people, including former principal secretary to Punjab CM Tauqir Shah, defied duty.

The Federal Investigation Agency (FIA) on Thursday submitted the commission’s report to LHC judge Justice Anwarul Haq hearing a plea for quashing an FIR registered against Tauqir Shah, political worker Talaha Barki and others.

The report says the judicial body recorded the statements of 16 witnesses, including Col (r) Ihsanur Rehman, Ex-adviser to Punjab CM Saeed Mehdi,  Research and Analysis Director Shahid Mehmood, Additional Inspector General of Police Nasir Khan Durrani, AIG Mushtaq Ahmad Sukhera,  FIA Director Zafar Ahamd Qureshi, a senior journalist, Constables Ijaz Ahmad and Muhammad Azam, IB joint director general, ISI Deputy DG Syed Ijaz Hassan Kazmi, ISI’s Brig Jamal Zia, MI’s Brig Muzaffar Ali Ranjha and Punjab Secretary Prosecution Rana Maqbool Ahmad.

The commission recommend Hassan be treated at the government expenses and rewarded suitably.

The judicial commission found Col (r) Rehman, Constables Ijaz and Azam jointly conspired to produce or put forward the false repot on alleged plot.

The findings recommended Col (r) Rehman be terminated immediately, saying that he should not be employed at any public position of responsibility while disciplinary action had been suggested against cops Ijaz and Azam. The jury also recommended considering disciplinary action against Tauqir Shah and avoiding appointing him at any sensitive post.

“Shah acted in haste, displayed immaturity and appears to be politicising the issue,” the report said.

On Aug 2, 2010, Col (r) Rehman sent a report of an alleged plot to assassinate ex-LHC CJ Khawaja Sharif to Punjab Chief Minister Sharif.

However, the report remained ‘unopened’ by September 4, 2010, when it was opened by an official in the presence of Tauqir Shah. In the meantime, the media flashed the report, prompting an initial probe that ridiculed it.

The officers of Special Branch and Punjab police, including Rehman, Mushtaq Sukhera, Shahid Mahmood, Naveed Elahi and Azmat Gondal started pressuring SI Shakeel Hassan to make him a scapegoat. Cashing in on Hassan’s poverty and his mother’s ailment, these officers tried to make him own the false investigation report. After his denial they mounted up pressure on him, but he remained steadfast.

Meanwhile, Attorney General Irfan Qadir has said that courts have no jurisdiction to issue notices to the President while sanctity of the highest office should be maintained by all and sundry.

Talking to reporters at Lahore High Court on Thursday, the AGP said President had the power to keep any office of his choice and courts had no power to issue notice in this regard. He said, “Being appointing authority of judges the office of the president is supreme then the judges.” He said the courts should respect the office of the president being head of the state.
