Judicial officers case hearing put off till 15th

KARACHI - The full bench of Sindh High Court (SHC) headed by Chief Justice Anwar Zaheer Jamali on Wednesday adjourned the hearing pertaining the government ordinance over the appointments of the judicial officials under Sindh Public Service Commission till 15 June. Rasheed A Rizvi Advocate, while representing the Sindh High Court Bar Association (SHCBA), gave his arguments before the full bench which was comprised of Justice Khilji Arif Hussain, Justice Sajjad Ali Shah, Justice Nadeem Azhar Siddiqui and Justice Karim Khan Agha over the petition moved by SHCBA challenging the Sindh Governments ordinance to appoint the judicial officials under Sindh Public Service Commission. Rizvi argued that the ordinance that gave the power to Sindh Public Service Commission to appoint the judicial officials, was the violation of the constitution. While, quoting the neighbouring country India, he said that there, the governor of the states are authorised to appoint the judicial officials in their judiciary with the approval of the concerned chief justices. According to the constitution of Pakistan, the Judiciary officials only can be appointed by the chief justice. So the recent ordinance, passed by the provincial government, was clear violation of the constitution. It translated the entire power to the executive from the judiciary regarding appointment of the officials in the courts. Rizvi has completed his arguments regarding the petition. Whereas Deputy Attorney General Ashraf Mughal and Advocate General Sarwar Khan were also present in the court. The Deputy Attorney General told the court that Attorney General of Pakistan would appear before the court in the next hearing to comment on the behalf of the government, therefore, he requested to grant further time in this regard. Plea for pre-arrest bail rejected A single bench of Sindh High Court of Justice Anwar Zaheer Jamali rejected the bail before arrest plea moved by ASI Allah Rakio Gabool. The plaintiff was charged to kidnap a couple including, Irfan Pathan and Khushbukht Gabool, who had married on their freewill in Sakkar. He was charged to kill Irfan Pathan, whose body was found in Mirpur Mathlio, while the girl is still missing. He was nominated in two separate FIRs in the case, in which FIR No 104/2009, under section 364-365-149, ppc was launched in Sakkar, while another FIR No 175/2009 under section 302-148-149, was registered in Mirpur Mathlio police station against him on 2 June 2009. The plaintiff submitted that he was not involved in any case of kidnapping and killing.
