LHC issues notice to DAG in MBBS admission case

LAHORE - A division bench of the Lahore High Court (LHC) has issued notice to the Deputy Attorney General for October 7 on a petition which challenges the self finance scheme for admission to dual nationality holders in the MBBS. The petition has been filed through advocate Rizwan Mushtaq aggrieving of the policy of the Higher Education of Pakistan to deny admission to the dual nationality holders in the medical colleges on the self finance basis on the ground they have done their intermediate in Pakistan when no such bar has been placed on their getting admission in BSc Engineering through the same scheme. The petitioner contends that such restriction on the dual and foreign nationality holders about admission in MBBS is contrary to the provisions of articles 4, 22, 25, 29 and 37(a) of the Constitution as it creates classes within classes without any tangible reason in addition to being contrary to the criterion and purpose set even by the Commission itself. He says the same is also violative of the provisions of Pakistan Medical and Dental Council (PMDC) on the premise that the Commission is not authorised to lay down a criteria which is based on something which is other than merit for the purpose of admission. The court after hearing the petitioner at preliminary stage issued notice the DAG to seek his assistance on the issue on the next date of hearing.
