Verdict reserved

LAHORE - The Lahore High Court Thursday reserved the verdict on a petition seeking disqualification of PML-M minority MNA Asfanyar M Bhandara and his membership from the National Assembly as an election petition is pending against him.
Justice Aysha A Malik of the LHC heard the petition moved by Pakistan Tehreek-i-Inqilab. The petitioner through his counsel argued an election petition is pending against Bhandara and till decision of it, MNA’s membership should be suspended and bar should be put on him to work as national assembly member.
In election petition, he had said that NAB references were pending against the MNA but he concealed this fact while filing his nomination papers before the Election Commission of Pakistan that no case was pending against him.
The counsel further said Isphandyar did not meet the criteria prescribed in the Constitution for a member of assembly. He prayed the court to invoke provisions of Articles 62 & 63 of the Constitution and disqualify the respondent member national assembly.
In another case, the LHC issued notice to the government and accountant general Punjab on a petition filed against deduction of tax on stipend of Rs3,000 paid to post graduate (PG) doctors.
Justice Ijazul Ahsan heard the case. The Judge directed the respondents to file their replies within two weeks. Dr Salman filed petition and submitted that accountant general office was deducting Rs3,000 to 4,000 on stipend of PG doctors on order of federal board of revenue.
He said that this stipend fall under category of scholarship B and under clause 47 of income tax ordnance 2001.
The petitioner prayed the court to declare the deduction from their stipend as illegal.
