DG FIA charged with contempt

ISLAMABAD - Director General FIA Malik Iqbal was charged with contempt of court for transferring Additional DG FIA Zafar Qureshi, who was an investigation officer in National Insurance Corporation Limited (NICL) scam. A three-member bench headed by Chief Justice Iftikhar Muhammad Chaudhry and comprised Justice Muhammad Sair Ali and Justice Ghulam Rabbani was hearing the contempt of court matter against DG FIA Malik Iqbal. The Chief Justice said as the DG had admitted to his crime, therefore he should be indicted. He remarked that Malik Iqbal spoiled the investigation of Haj and NICL cases. Abdul Hafeez Pirzada appeared on behalf of Director General FIA Malik Muhammad Iqbal, while Attorney General for Pakistan appeared on court notice. After discussing the matter at length, the AG was directed to prepare the charge sheet, who within an hour submitted charges against DG FIA. The CJP read out the charge sheet against DG. He remarked that the court had not taken any strict action against him but now no leniency would be shown to the culprits. Law demands strict action from the court, he added. Malik Iqbal pleaded not to contest the charges, but explained that he had no intention to violate the court order. In his written statement, submitted before the bench, he stated: I dont want to contest the charges. However, I most respectfully submit that it was not my intention or objective to undermine the honourable court to subvert its orders and directions. I stand by my earlier statement submitted through my counsel, Makhdoom Ali Khan. I humbly and respectfully seek clemency of august court by way of extenuating circumstance. I am superannuating on 14th July, 2011 and shall immediately proceed on leave. The court directed AG to procure complete record of the investigation in National Insurance Company Limited (NICL) scam, conducted by Zafar Qureshi and other FIA officers after Zafar, enabling the court to proceed further. Secretary Interior Qamar-uz-Zaman was ordered that he should submit record of the letters, which he has sent to the Establishment Secretary for dissociating Zafar Qureshi from the NICL investigation. Secretary Establishment Division Abdul Rauf Chaudhry was asked to provide record of documents on whose basis the notification for transferring Zafar Qureshi from NICL case was issued, while the FIA officials have been directed to provide the record of zimini (supplementary notes of the investigation officer). Earlier, the court asked Malik Iqbal what action has been taken against Amin Fahim, Federal Minister for Commerce, in light of the revelation made in the National Assembly Standing Committee by FIA officials. The Chief Justice said: We have been showing restraint but the DG FIA has taken undue benefit of our patience. Justice Sair said in the last hearing the court had directed him to depute Inam Ghani, another FIA officer, for investigating Haj corruption but due to Malik Iqbal he has been made OSD. The case was adjourned till 8th June.
