ISLAMABAD - The Supreme Court of Pakistan Thursday declared the verdict of Peshawar High Court (PHC) in Khyber Pakhtunkhawa employees’ promotion allowance case as null and void.
A three-member bench of the apex court headed by Chief Justice of Pakistan Justice Gulzar Ahmed conducted hearing of an appeal of the KP government against the PHC verdict. Peshawar High Court had directed the provincial government to increase the promotion allowance in KP like other provinces.
Justice Ijaz ul Ahsan said that the PHC has no authority to order the provincial government to increase the allowance.
The Chief Justice said that it is the government and not the court which determines the allowance. He said that the court would not intervene in the affairs of the government. Justice Syed Mahazar Ali Naqvi said that after the 18th Amendment the provinces were empowered to decide about the employees’ salaries.
CJP says it’s government not court to determine promotion allowance
The Chief Justice said that it is not the job of the courts to see what the governments are doing. The Advocate General KP said that the KP government has fewer funds in the budget.
Chie Justice Gulzar remarked that the government does not have funds and that all the money in the KP is of Asian Development Bank. He said that it is the decision of the KP government that how much it wants to allocate for the promotion allowance.
