ISLAMABAD-In a violent protest against the demolition of lawyers chambers, the black coats Monday barged into the Chief Justice Block of the Islamabad High Court and wreaked havoc there.
The enraged lawyers ransacked the chamber of Chief Justice of IHC Justice Athar Minallah and also chanted slogans against him and Capital Development Authority (CDA) for the demolition of their chambers at Islamabad district courts in F-8 sector.
Later, the court officials told that Justice Athar has directed to close the high court as well as district courts of the federal capital till the solution of the issue. They said that the legal proceedings in the courts would remain suspended till further order and in this regard, the cause list for Tuesday (today) has been cancelled.
The members of legal fraternity caused havoc in the IHC building as they protested over the destruction of their chambers by the CDA. They barged into the Chief Justice Block and broke windows and chanted slogans against the IHC CJ outside his chamber, trapping him inside. The IHC top judge was inside his chamber at the time. Special security police troops were not present when the lawyers entered the block and arrived much later.
The legal proceedings in IHC remained suspended and petitioners were stopped from entering the building. The road outside the court was blocked for traffic. The lawyers also misbehaved with journalists who were present on the scene and were recording videos.
On this occasion, Justice Mohsin Akhtar Kayani and IHC Bar Association President Haseeb Chaudhry urged the rioting lawyers to opt for dialogue. Justice Kayani said that they would not be able to solve the problem until you people put your stance before them. He invited the lawyers to talk in the bar room.
However, the protesting lawyers refused to talk saying that they would not talk until their chambers are restored. They also claimed that some of their colleagues were arrested.
Assuring the release of their colleagues, Justice Kayani said that give the names of the lawyers who were arrested and he would order the SP straight away to release them. Expressing his sorrow over the incident, he said that lawyers have caused double trouble by attacking the high court chief justice’s chamber.
The IHC judge said that a chief justice is chief justice, you have put his credibility and verdicts at stake. Addressing the lawyers in Quaid-i-Azam hall of the IHC, Justice Kayani said that members of the legal fraternity were gathered outside the CJ’s chamber should return.
He said that your problem was [related to] four to five chambers which could have been solved through dialogue.
He told the IHCBA president and secretary to “cooperate” and convince the lawyers to gather in the hall for a dialogue. The judge also ordered the senior superintendent of police to release all lawyers and others who had been arrested, on the protesters’ demand.
The judge said to the lawyers that you should have told this issue to the Chief Justice but if you tell him after causing a ruckus, how the matter would be resolved? He added that the Chief Justice is your strength, what you did in his office had no excuse. He further said that the elements which are against the judiciary and lawyers would take advantage of this and urged the lawyers to not make matters worse.
Haseeb also asked the lawyers to submit their demands and assured them that he would get them fulfilled. He said that the damage done to the IHC building today, is also his loss. He further said that if you cause a ruckus like this then do not complain that your president is not with you.
Later, the lawyers presented their six demands including reconstruction of chambers as well as compensation. These demands included immediate release of arrested lawyers, rebuilding of all chambers that were demolished by the administration, along with rebuilding, administration should pay Rs500,000 per chamber in compensation, transfer of Islamabad deputy commissioner, concerned superintendent of police and session judge from the capital, till the transfer of district courts, chambers for young lawyers be built on the land of a football ground in Sector F-8 and 10 acre land be allotted for lawyers’ chambers in the area where district courts are transferred.
Besides this, the IHC Bar Association President Haseeb Chaudhry said that the lawyers had been summoned by the Chief Justice of Pakistan. He said that both lawyers and administration officials would appear before the CJP. He further said that all the lawyers who were arrested had been released.
Meanwhile, a notice was issued by IHC Bar Association Secretary Suhail Akbar Chaudhry, announcing a strike and saying that the body would not only protest against the “injustice,” it would also take strict action, if needed.
The bar notice said that all esteemed bar members are informed that Islamabad district administration and CDA have cruelly taken down chambers of young lawyers and the IHCBA will not remain quiet on this cruelty and injustice and will not only protest against [it] on every forum but will take strict action if needed.
Later, the police registered a case under terrorism charges against some 300 lawyers for vandalising Islamabad High Court, detaining Chief Justice, torturing journalist and snatching official riffle from gunman of CJ during a protest against bulldozing their illegal chambers by CDA in an anti encroachment operation, sources informed late night.
