LHC snubs DC Rawalpindi for  not appearing  before court

RAWALPINDI- Lahore High Court (LHC) Rawalpindi Bench Justice Sohail Nasir on Tuesday got annoyed at Deputy Commissioner (DC) Amir Aqiq Khan for not appearing before court despite summoning several times.
The court also issued a contempt notice to DC Rawalpindi for his disrespectful attitude towards the court. “If DC cannot appear before court, we will set up court there where he (DC) feels comfortable. Look at the attitude of head of district government and it’s a big bad luck of system,” LHC Justice Sohail Nasir observed.
The contempt notice was issued by judge of apex court while hearing a petition of Makhdoom Syed Nasir and brothers, caretakers of Darbar Hussaini, through Mustafa Kundwal Advocate, challenging the order of Justice of Peace 7 August 2021. In the order, Justice of Peace had directed police to provide security to the organizers of mourning processions to be taken in Kallar Syedan under leadership of Shamim Ul Hassan Naqvi despite rejection of district government. Makhdoom Syed Nasir challenged order of Justice of Peace with LHC Rawalpindi Bench which declared order of Justice of Peace as null and void.
When LHC Rawalpindi Justice Sohail Nasir took up petition, AC Headquarters Aneesha Hasham appeared before the court on behalf of DC Amir Aqiq Khan but she could not satisfy the court in this regard. On this, Justice Sohail Nasir expressed his annoyance and issued a contempt of court notice to DC.
He also ordered DC to appear before court at 12pm and to explain his position in the matter.
DC Amir Aqiq Khan appeared before court and tendered apology which was accepted by the apex court and notice was cancelled. Earlier, the petitioners Makhdoom Syed Nasir and brothers argued before the court that the caretakers of Gulshan e Zahra Imambargah has been taking out mourning processions for last 150 years. He said DC refused to give NOC to management of Gulshan e Zahra Imambargah but Justice of Peace directed police to provide the mourners with security.
