LAHORE A two-member bench of the Lahore High Court on Monday directed the LDA Director General to submit a representation by Jan 2 about residential plots gifted to the judges of LHC by former prime minister Nawaz Sharif. The bench headed by Justice Muhammad Khalid Mehmood Khan issued this order while hearing a 17-year-old case seeking cancellation of residential plots given to judges of the Lahore High Court in Nawaz Sharif tenure as prime minister in 1993. Presently the bench was hearing an intra court appeal against decision by a single bench wherein writ petition on the matter was dismissed. The petitioner Saiful Haq Ziayee Advocate filed the main petition in 1993 and the single bench had dismissed the same in 1994. He challenged that order through an ICA which was never heard after 2002. The petitioner pleaded allotment of plots to LHC judges was unlawful as proceedings laid down by LDA was not followed while doing allotment of plots in Johar Town and Garden Town. He impleaded former LHC CJ Mian Mehboob Ahmad, former Justice Sheikh Ijaz Nisar, Khizar Hayat, Fazal Karim, Raja Afrasiyab, Rashid Aziz Khan, Khalid Khawaja, M Amir Malik, Ihsanul Haq Chaudhry, and Muhammad Aslam. Advocate Ziayee submitted that under rules plots could only be allotted to judges who did not have any plot for residential purposes.
