ECP reserves decision on Noor Alam reference

ISLAMABAD  -  Election Commission of Pakistan (ECP) on Thursday reserved decision on the dissident PTI MNA Noor Alam Khan disqualification reference.


During the hearing of 20 dissident members of PTI, Noor Alam Khan’s counsel while citing Article 63 A (1) raised objection to the reference which was sent by the then NA Speaker.


A three-member ECP bench headed by Chief Election Commissioner along with Shah Muhammad Jatoi and Nisar Ahmed Durrani heard the case.


Noor’s lawyer argued that the ECP could not hear the reference as it was incomplete. He said that his client had not violated Article 63-A as he did not vote on the no-trust motion against Imran.


The PTI lawyer Faisal Chaudhry said that incomplete ECP is irresponsibility of the Parliament and it is unconstitutional to raise questions on ECP jurisdiction. He said that the Election Commission has wide powers under Article 218 and said that ECP has complete authority to make a decision on the references.


Faisal Chaudhry argued that Election Commission is not responsible for the commission being incomplete and ECP is supposed to decide on the references within 30 days.


It is pertinent to mention here that former Speaker of the National Assembly had sent declarations against 20 dissident PTI members on 14 April to the Chief Election Commissioner.
