SC to determine if disqualification under article 62-1 F will be for one year or for life: CJP

ISLAMABAD: Chief Justice of Pakistan (CJP) Mian Saqib Nisar has remarked “the court will determine if the disqualification under article 62-1 F will be for life or for one year.

The CJP gave these remarks Friday while presiding over a 3-member bench of Supreme Court (SC) during the course of hearing of election petition pertaining to cantonment board Multan.

After hearing the arguments of the lawyers, the court dismissed the petition filed by elected chairman Hummayun Akbar against the decision of the tribunal.

The petitioner took the plea that tribunal had disqualified him under article 99 for not revealing Bank account. “my client became disqualified for life due to the decision of the tribunal”, he added.

CJP inquired where is the ban imposed on you for contesting the election again. You did not reveal Rs 37 lac lying in your bank account. SC has remarked in Nawaz Sharif case that concealing the assets is dishonesty.

Justice Ejaz ul Ahsan remarked “ tribunal had nullified your election and not you.

Justice Umar Ata Bandial remarked “there is the difference in the application of 62-1 F and ROPA law and 99 F. Tribunal has not given the finding of disqualification against you.

The CJP remarked “ the court had declared null and void Iftikhar Cheema election under 99-F. Iftikhar Cheema was re-elected in by polls.

CJP remarked “we will determine if the disqualification under 62-1 F will be for one year or for life. The larger bench is hearing the matter of article 62-1 F from January 30. Whatever decision is given by the larger bench on article 62-1 F will be the law of future.
