ISLAMABAD-The Islamabad High Court (IHC) Friday observed that the authorities of Cyber Crime Wing of Federal Investigation Agency (FIA) are continuously violating court’s directions while issuing notices on allegations of cyber crimes.
A single bench of IHC comprising Chief Justice of IHC Justice Athar Minallah made the observation while hearing a petition of a journalist Bilal Ghauri challenging the summons issued by the FIA to him.
After hearing the petition, the IHC bench suspended the call up notice issued by the FIA to the journalist and also summoned Director Cyber Crime Wing in person on the next hearing to be held on June 30.
The IHC bench directed the FIA director to appear before the court and explain that why its orders dated November 3 were not implemented.
During the hearing, Iman Mazari and Usman Warraich advocates appeared before the court on behalf of journalist Ghauri and adopted the stance that FIA was misusing its authority.
They added that Ghauri had been summoned without giving any reason.
The IHC Chief Justice said that the court had repeatedly pointed out that fundamental rights should be taken care of but the FIA officials were constantly repeating the same exercise and violating the court orders.
The bench also directed the registrar office to club all the identical cases against the FIA notices for proceedings together on the next date of hearing. Later, the court deferred the hearing till June 30 for further proceedings.
In this matter, M. Waseem Sikandar, a sub-inspector of the FIA’s Cyber Crime Wing issued summons for Ghauri to appear for questioning on June 25 regarding his alleged defamation through social media.
The summons stated that it was issued in response to a complaint by Syed Abbas Mohiuddin, a former member of the Provincial Assembly from Attock district, but does not describe the specific defamation allegations. A
