ECP asks Imran, Asad Umar to produce evidence favouring their stance

ISLAMABAD - Election Commission of Pakistan (ECP) on Tuesday asked Pakistan Tehreek-e-Insaf (PTI) lawyer to produce evidence favouring their stance to the Commission otherwise their appeal will be dismissed.

PTI Chairman Imran Khan and Asad Umar had been fined 50,000 by ECP on violation of code of conduct (CoC). A three-member bench headed by Chief Election Commissioner Sikandar Sultan Raja, Nisar Ahmed Durrani and Shah Muhammad Jatoi heard the fine appeal against former Prime Minister Imran Khan and Asad Umer. During the hearing the PTI lawyer told the court that writ petition had been filed in Islamabad High Court against ECP’s order and said the writ petition hearing was underway.

The CEC questioned the PTI counsel that had IHC issued a stay order against ECP proceedings?

PTI counsel said that hearing had been delayed due to unavailability of a new appointment of Attorney General and said that it would be appropriate to let the IHC decide first the case. The ECP would continue its proceedings in the case of code of conduct violations against the petitioner, said the CEC, and added “This is your stance to not decide the matter now”.

However, the court has given last chance to the PTI counsel to present the evidence in case of 50,000 fine imposed on Imran Khan, Asad Umar and adjourned the hearing after Eid.

It is noteworthy to mention here that ECP had barred former premier Imran Khan from visiting Swat. Khan addressed public gathering there and allegedly violated code of conduct. Lower Dir District Monitoring Officer (DMO) Hameedullah had imposed a fine of Rs 50,000 on the then PM Imran Khan for violating the electoral code of conduct.

The ECP had twice issued notices to Imran Khan over violation of code of conduct.

Allegations of CoC violation

The last notice served to Khan was on March 21 for addressing a political rally in KP’s Malakand area along with other PTI leaders.

Furthermore, the DMO Malakand had sent two notices, on March 20 and March 22, to the former prime minister through his secretary to appear personally or through his counsel to explain his position for violating the code of conduct by addressing a public meeting in Malakand on March 20.

Earlier, the ECP had also issued notices to Pakistan People’s Party (PPP) Chairman Bilawal Bhutto Zardari for addressing a public meeting in Malakand on March 23.

According to the new ECP code of conduct, no public office holder can visit the districts where elections are/about to begin/be held.
