Peshawar High Court (PHC) while rejecting bail plea of two accused in Mashal Khan murder case has directed the prosecution to file challan in trial court in respect of accused persons within 15 days.

The PHC ordered trial court to complete the hearing of the case within 2 months after the challan is filed.

A single bench of PHC presided over by Justice Nasir Mehfooz took up for hearing bail plea of the accused including Izhar Ullah alias Johni and Sabir Mir on Tuesday.

It may be recalled that Mashal Khan a student of mass communication department at Abdul Wali Khan University Mardan was lynched in April 2017 on blasphemy charges.

The case was run in Anti-Terrorism Court (ATC). The court had declared 31 out of 57 accused as culprits.

The major accused Imran Khan was awarded capital punishment, 5 accused were awarded life sentence and 3 accused were sentenced to 25 years in jail each.

ATC had however acquitted 26 accused remarking prosecution had failed to provide evidence against them.

The two petitioners Izhar Ullah and Sabir had absconded. Later they were arrested by police. The trial court had issued arrest warrants of 4 accused including Izhar Ullah and Sabir and they were declared proclaimed offenders.

Later Izhar Ullah, Sabir Mir, Arif Khan and Asad were arrested. The ATC had rejected their bail plea.
