Secretary Assembly says no stay order found against oath-taking

LAHORE - Veteran politician Ch Nisar Ali Khan may take oath of his Punjab Assembly membership during Wednesday’s Assembly session (today) as no stay order from any court has been found on checking of the record. 

Secretary Punjab Assembly Muhammad Khan Bhatti Tuesday told the media that all the relevant record has been checked and no stay order has been found barring the politician to take oath of Assembly membership.

Talking to The Nation, DG Parliamentary Affairs Punjab Assembly Inayatullah Luck also confirmed that there was no legal hitch in the way of Ch Nisar’s oath-taking and he could come any day to take the oath.

Earlier, on Monday last, the Assembly Secretariat did not allow him to take oath as MPA citing different reasons.

He was told that both the Speaker and the Deputy Speaker were not available to administer the oath.

Nisar left the Assembly after waiting around two hours.

Later when some news channels reported that the Panel of Chairman can also administer the oath as he had all the powers of the Speaker, the Assembly Secretariat came up with another excuse.

It was later officially conveyed to the media by the Secretary Assembly that at least three to four petitions seeking de-seating of Ch Nisar were lying pending in the Rawalpindi bench of Lahore High Court and at its Principal seat at Lahore.

In such a situation, he pleaded, there was a possibility of committing contempt of court by the Assembly if there was any stay order from the court. The Secretary Assembly had also stated that two days were required to check the relevant record.

It is, however, not confirmed as yet whether or not the politician from Chakri will come to the Assembly on Wednesday (today) to take oath of his Assembly membership.   

Also, SACM, Dr Firdous Ashiq Awan Tuesday said that Chaudhry Nisar was facing five writ petitions [seeking his de-seating] and it would have been a contempt of court had he been allowed to take oath on Monday.

She also said that Ch Nisar insulted the public mandate for three years by not taking oath.

She said the government will create no hurdle after the court verdict.
